Privacy Policy

By using the website www.themoderatorcommunity.com (the ‘Website’), owned and managed by Starfish Community Groups S.L. ('The Moderator Community'), you (the 'User') accept the following privacy policy (the 'Privacy Policy'), which governs the data processing undertaken through the Website and concerning the services found thereon (the 'Services').

Users are also aware of The Moderator Community's Terms and Conditions governing the Services offered on the Website. In the event of inconsistency between this Privacy Policy and the Terms and Conditions, the Terms and Conditions shall prevail.

The Moderator Community is committed to protecting User's privacy. This Privacy Policy describes how The Moderator Community collects, receives, uses, processes, and shares information concerning the User, including but not limited to User's name, address , email address, or phone number ('Personal Data'). When User registers with The Moderator Community, User's Personal Data and other data will be stored and processed in the US, Spain and in Germany , and this information will be subject to the laws of Spain. In order to use the Services and provide User's Personal Data, User must be of legal age or have User's legal representatives permission in accordance with applicable law.

I. How we collect and use User's Personal Data

1. General
The Moderator Community collects Personal Data when User signs up with The Moderator Community to use the Services and each time User uses the Services. Personal information includes information such as your name, email address, address, telephone number and date of birth.

When User signs up, The Moderator Community may ask for User's username, name, email address, and password. In the future User may be able to add certain optional information to User's profile, such as User's address, home town, gender, birthday, biographical information, and personal interests.

The Personal Data collected by The Moderator Community by any method will be incorporated in a database called "db.linqia.com" , located in Germany . This file is managed by The Moderator Community and will be registered with the Spanish Data Protection Agency. Data requests are mandatory wherever so indicated in the Website. The purpose of the data processing is to allow The Moderator Community to properly perform the Services and to be able to provide User with best and most complete experience possible. During the performance of the Services, The Moderator Community may require the international exchange or transfer of Personal Data solely for the provision of the Services. By entering Personal Data in the Services or by otherwise disclosing Personal Data, User gives explicit consent to data processing described herein and in particular that User's Personal Data may be transferred across international borders to a location outside the country of User's location, always in compliance with applicable law.

Additionally, The Moderator Community may use the data collected for sending commercial communications from The Moderator Community and third party companies that may be of User's interest and which will be clearly identified in the relevant commercial communications. The Moderator Community will process all the data and will send the communications to the User, NOT transferring the data to any third party.

The Moderator Community guarantees that it will apply the legally required security measures in order to keep User data strictly confidential and will only use the data for the purposes set out in this Privacy Policy.

The Moderator Community automatically receives and records information on its server logs from User's browser, including User's IP address, cookie, and the page User requests.

2. Use of Cookies

The Moderator Community may use cookies on the Services. A cookie is a small file, which often includes an anonymous unique identifier, which is sent to User's browser and stored on User's computer's hard drive.

If User does not wish to have cookies placed on User's computer or wishes to be notified when they are placed, User may set User's browser to reject cookies or notify User of their use. If User rejects all cookies, User will not be able to use those parts of the Services that require User to "sign in".

The Moderator Community uses its own cookies for a number of purposes, including but not limited to, accessing User's information when User "signs in"; keeping track of preferences User specifies while User is using the Services; and displaying the most appropriate advertising banners based on User's activity on the Services.

The Moderator Community permits other companies involved in the provision of the Services (i.e. affiliates, advertisers, etc.) to issue cookies through the Website, subject to their own privacy policies. User may configure User's browser as explained above for The Moderator Community's cookies and shall check those privacy policies from time to time.

II. How we share User's Personal Data

When User posts information on the Website, User's The Moderator Community username that User is posting under is visible to other users. If User post Personal Data online that is accessible to the public, User understands that this can be accessible to any user of the Internet (except when stated otherwise by The Moderator Community) with all of the relevant consequences (i.e., User may receive unsolicited messages from other parties in return).

Generally, The Moderator Community does not share User's Personal Data with third parties or non-affiliated companies without User's prior consent except to the Services or in the following circumstances:

a. The Moderator Community may be required to disclose personally identifiable information under special circumstances, such as to comply with legal requirements or to exercise its legal rights;
b. It may be necessary to share Personal Data in order to investigate, prevent, or take action regarding suspected or actual illegal activities on or through the Services, including but not limited to violations of the Terms and Conditions or infringement of third party intellectual property rights, or as otherwise permitted or required by applicable laws;
c. The Moderator Community may share aggregated demographic information with its business partners. This is not linked to any Personal Data that can identify any individual person without the prior consent of that person; and
d. In the event The Moderator Community enters into a joint venture or is acquired by or merged with another business entity, we may disclose User's Personal Data to our business partners or new owners.
The Moderator Community may contain links to other websites. We are of course not responsible for the privacy practices of other web sites. We encourage our users to be aware when they leave our site to read the privacy statements of each and every web site that collects personally identifiable information. This Privacy Policy applies solely to information collected by The Moderator Community.

III. Editing or deleting User's account information / Exercising User's rights

With regard to any of User's Personal Data provided to The Moderator Community, User shall have the rights of access, correction, deletion and objection regarding its personal data. Such rights may be exercised by notice in writing sent to The Moderator Community's registered address (as shown at the end of this Privacy Policy) or by e-mail sent to privacy @The Moderator Community.com. Moreover, the User may unsubscribe to commercial communications received from Linqia by following the instructions included in each communication sent.

User can edit User's The Moderator Community account information at any time and User can delete User's The Moderator Community account at any time from User's account page; however, please note that User's identification, billing and contact information may remain in The Moderator Community's records for some period after the deletion.

IV. Log Files

Each time User accesses the Website, The Moderator Community will save the following data in a log file:

a. User's IP address (by which User's computer can be clearly identified),
b. The name and IP address of the computer requesting the respective page from the Website,
c. The time, status, and amount of the transferred data, as well as the Internet website from which User has reached the requested page of the Website,
d. The product and release information from User's Internet browser.

This log file will be stored by The Moderator Community in the standardized "combined" log file format for the Apache Web server. The Moderator Community uses the data from this log file in anonymous form without reference to User's person for statistical purposes. In doing so, The Moderator Community may analyze on which days and at which time the Services are particularly frequented and how much data volume is created on the Website. Furthermore, by using the log file, The Moderator Community can identify defects on the Website, such as defective hyperlinks or program defects or security issues, and thus continually improve the quality of the Website. The Moderator Community does not attribute the website demands stored in the log file to specific individual users. However, The Moderator Community reserves the right to review the log files from the last known IP address of User where The Moderator Community has reasonable cause to believe that User is using The Moderator Community Services in breach of contractual agreements or the applicable legislation. In doing this, The Moderator Community is protecting other The Moderator Community users, the safety of The Moderator Community users' data, as well as the Website and the Services.

V. Content

You post User Content on the Site at your own risk. Although we allow you to set privacy options that limit access to your pages, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other Users with whom you may choose to share your pages and information. Therefore, we cannot and do not guarantee that User Content you post on the Site will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Site. You understand and acknowledge that, even after removal, copies of User Content may remain viewable in cached and archived pages or if other Users have copied or stored your User Content.

VI. How we can modify this Privacy Policy

User understands that The Moderator Community is continuously developing the features and the functionality of the Services, the Website, and the related software. Consequently, we also reserve the right to modify this Privacy Policy at any time in our sole discretion. User agrees that such alteration shall be effective upon posting on the Website and User will be bound to any alterations when User uses the Services after such alteration is posted. It is therefore important that User review this Privacy Policy regularly on the Website to ensure that User is updated regarding any alterations. User's sole remedy should User not agree with the altered Privacy Policy shall be to close User's account and to cease using the Services.
