1. Thank you for one year of The Moderator Community!

 

This week, we celebrated our first birthday! After almost six months of researching resources, creating wireframes and implementing our site with Drupal, The Moderator Community "officially" opened its doors to the public on January 21st 2009.

 

A lot has happened in the last year; we now have over 1,500 resources on community management and social media, and over 500 members. The site has seen some redesigns, new features (like our job board in collaboration with Monster) and we've published our first paper - a guide on social media for business. We're excited about this project, and hope to bring it even further in the next year.

5. Report on Spanish Online Communities

 

In our July Newsletter, we invited you to participate in a survey on Spanish online communities. Miguel Cornejo Castro and his team at Macuarium Networks have now published the resulting report: Estudio de Comunidades Online 2009. We invite you to check out the results on their site! Currently, there is only a Spanish version - we'll notify you on our blog as soon as an English version is available.

 

 

6. Our First Moderator Community Get Together

 

On December 2nd, we had our first little Meetup with Moderator Community members in Barcelona. Although the meeting was organized and announced on short notice, we still had a nice little group of community managers, developers, and social media experts from all over the world. As the meeting was informal, there was no agenda - discussions around the table included how to market your online community, the importance of managing your professional online identity and white label platforms for online communities.

 

Thanks to everyone who attended, it was great to meet you in person! We hope to organize more Meetups in the future, and are looking forward to getting to know more members of our community.

 

 

7. A little note from the Team

 

Well, this is it - our last newsletter for 2009. It's been almost one year since The Moderator Community launched. We had a great year and really enjoyed managing and developing this community. Thank you for supporting the community - all the registrations, posts and comments are always encouraging, and give us reason to continue investing our effort into this project we truly believe in.

How does the new FTC Regulation affect social networks and online communities?

In summary: What is the FTC regulation all about?

The Federal Trade Commission (FTC) of the US recently published an updated guide providing "administrative interpretations“ for laws concerning endorsements and testimonials in advertising. For the first time, the guide also specifically mentions social media, particularly bloggers, and what their responsibilities are when endorsing a brand or product online. Basically, anyone who gets paid or otherwise compensated for writing about a product or service, has to disclose this relationship. Claims made by an endorser may not be misleading.  This has mainly been discussed for bloggers, but these guidelines should also be adhered to in social networks, microblogging services like Twitter and in online communities, groups and forums.

 

 What’s an endorsement

According to the FTC, „an endorsement means any advertising message [...] that consumers are likely to believe reflects the opinions, beliefs, findings, or experiences of a party other than the sponsoring advertiser, even if the views expressed by that party are identical to those of the sponsoring advertiser.“

 

„Endorsements must reflect the honest opinions, findings, beliefs, or experience of the endorser. Furthermore, an endorsement may not convey any express or implied representation that would be deceptive if made directly by the advertiser.“

 

The guide gives an example of a blogger who writes about dog food:

  • If she just decides to try a new brand, likes it, and writes about it: not an endorsement
  • If she gets a coupon from her supermarket for a free trial because the store „...routinely tracks her purchases and its computer has generated a coupon for a free trial bag...“ and writes about the food: not an endorsement
  • If she joins a network marketing program and receives products periodically, receives a free bag of dog food and writes about it: this would be an endorsement.

 

 

When is disclosure needed?

„When there exists a connection between the endorser and the seller or the advertised product that might materially affect the weight or credibility of the endorsement (i.e. the connection is not reasonably expected by the audience), such connection must be fully disclosed.“

 

For example, if a game expert receives a game console for free and reviews it: „Because his review is disseminated via a form of consumer-generated media in which his relationship to the advertiser is not inherently obvious, readers are unlikely to know that he has received the video game system free of charge in exchange for his review of the product, and given the value of the game system, this fact likely would materially affect the credibility they attach to his endorsement. Accordingly, the blogger should clearly and conspicuously disclose that he received the gaming system free of charge. The manufacturer should advise him at the time it provides the gaming system that this connection should be disclosed, and it should have procedures in place to try to monitor his postings for compliance.“

 

 

What is the advertiser’s responsibility?

„The advertiser is subject to liability for misleading or unsubstantiated representations made through the blogger’s endorsement“

(Example: If an advertiser asks a blogger to test a body lotion and the blogger writes that the lotion can cure eczema, the advertiser is liable for this misleading claim – even if the advertiser has not made such claims). Advertisers must also make sure that any person that receives incentivization by them discloses this fact when writing or speaking about a product.

 

 

How can advertisers ensure compliance?

Advertisers should ensure that anyone who is speaking on their behalf or endorsing them knows about these rules beforehand. They should consider providing their endorsers with guidelines and suggestions on how to disclose the relationships. Additionally, advertisers must monitor for compliance and have the responsibility of halting publication of claims that could be considered deceptive.

 

 

What is the endorser’s responsibility?

While it is unlikely that the FTC will go after single bloggers, it states that „the blogger is also subject to liability for misleading or unsubstantiated representations made in the course of her endorsement. The blogger is also liable if she fails to disclose clearly and conspicuously that she is  being paid for her services.“

 

 

How does this affect brand engagement in social networking services?

Whilst these guidelines have been discussed in relation to bloggers, the guide clearly also targets any other form of social media. An important point is that according to the FTC, consumers might not realize that messages in social networks or on message boards are from paid endorsers. Anyone who has a relationship with a brand or product, whether it be by employment or any kind of payment or incentivization, should therefore disclose their relationship to the advertiser when speaking about this brand.

 

Employees of a brand can no longer go on message boards and praise their products without informing the community that they are working for this company.

 

How should disclaimers be made?

Disclaimers should be made „clearly and conspicuously“. There have been discussions about blanket disclaimers that would just appear on one page, for example a blogger’s „About“ page. This will probably not be considered conspicuous enough. To be on the safe side, it is probably best to include a disclaimer within a blog post or discussion post, where any reader can be expected to see it.

 

 

What happens if a brand or an endorser does not comply with these guidelines?

Violations – and this concerns the brand as well as the endorser - are punishable by civil penalties of up to $11,000 per violation. That fine is probably a smaller part of the damage though – considering how fast word travels in social media, the damage to a brand or endorser’s image could be much higher than that.

6. Legal Issues for Online Communities: Let's create a resource collection!

 

Since we've heard a lot of concerns about legal issues for online communities recently, we have started putting together a collection of resources related to legal matters - links to government websites, blogs about online law, specific cases related to online communities etc. It would be great if we could collaborate on this list as a community! If you have any links to share, or know any specialists in the area, please add them to the list by posting a comment.

We entered The Moderator Community for this year's Groundswell Awards. These awards aim to recognize the "excellent and effective use of social technologies to advance an organizational or corporate goal". Whilst we are still at the beginning of our journey with The Moderator Community, we do think this community has a lot of potential to support, engage and inspire community managers, group moderators and social media experts.

Picking the right features for a community – or how to bake a cake.

I have been involved in a number of community creations in the past few years, either as a consultant or just speaking to friends. One thing that always struck me as odd was that many people can list the features they want in the community, but don’t have any idea about what the purpose of their community should be. „I want to build a community, and I really want it to have a wiki, and groups, and subgroups, and sub-subgroups.“ To me, that’s a little bit like saying you’d like to bake a cake, and it should have baking soda and flour and some vanilla in it. The only time you would look at the ingredients this way before baking a cake, is when it’s 10pm on Saturday evening, no stores are open, and you really need a cake right now because your mother in law is coming over on Sunday. Then, you’ll take all the ingredients you have, and try to make something out of it – out of desperation. When you’re planning out a community, you’re usually not that desperate. So why pick out the ingredients before deciding on a cake? Wouldn’t it make much more sense to decide that you’d like a chocolate cake first, and then take the best chocolate cake recipe you can find, to see what ingredients you’ll need? That’s how I like to approach community development. First, I map out my goal – what do I want to achieve with this community? What is my purpose or my end goal? Then, I break this down into sub-goals, little things I need to achieve or that the community needs to enable in order to live up to its purpose. I take this list of sub-goals, and match each one up with the features that are needed to achieve it. For example, with The Moderator Community, one of our goals was to assist community managers with their careers. What would help them with their career? In our view, it was access to jobs, an easy way to connect with peers, and a way to easily find information and knowledge on community management. After establishing this, we thought about the features needed to achieve this. To provide access to jobs, we created a job board, where anyone would be able to post jobs. Later, when we realized our job section was one of the most popular areas of the community, we built on what we already had, and added a job feed from one of the biggest job sites in the world, Monster. For a way to connect with peers, we built user profiles, buddy lists and groups on specific topics. The resource section, which is essentially a link library, serves to provide access to information, and so on. The key is to choose your features wisely, with the end result in mind. A feature shouldn’t be added just because it’s new and the cool thing to have right now. Rather than trying to maximize the number of features in your community, focus having a few key features that will drive the community’s purpose, and on making those as easy to use as possible. Decide on what the community should achieve, and then choose the ingredients that will get you there. If you absolutely have to have that wiki regardless of your goals, then have it (I put vanilla in every cake I make, regardless of the recipe. I just like its flavor). But always remember your community’s purpose and focus on advancing that. The vanilla isn’t going to make a chocolate cake if you forget the chocolate!
